{"id":5844,"date":"2013-12-03T16:08:38","date_gmt":"2013-12-04T00:08:38","guid":{"rendered":"http:\/\/www.pnwumc.org\/news\/?p=5844"},"modified":"2013-12-03T16:19:39","modified_gmt":"2013-12-04T00:19:39","slug":"umns-finance-agency-responds-to-clergy-housing-decision","status":"publish","type":"post","link":"https:\/\/www.pnwumc.org\/news\/umns-finance-agency-responds-to-clergy-housing-decision\/","title":{"rendered":"UMNS: Finance agency responds to clergy housing decision"},"content":{"rendered":"<p><em>Editor\u2019s Note: The General Council on Finance and Administration \u2014 The United Methodist Church\u2019s finance agency \u2014 responded Nov. 26 to \u00a0a U.S. district court ruling that found the tax-free housing benefits for clergy to be unconstitutional.\u00a0 GCFA\u2019s full statement is below.<\/em><\/p>\n<div>\n<p>NASHVILLE, Tenn.\u00a0\u2014 On Nov. \u00a021, 2013, a federal district court judge in Madison, Wis., \u00a0held that a portion of Section 107 of the tax code is unconstitutional.\u00a0 Section 107 is the provision dealing with tax-favored housing benefits for clergy.\u00a0 Specifically, the court held that Section 107(2), which permits clergy to receive a tax-free cash \u201chousing allowance,\u201d is unconstitutional because it violates the Establishment Clause of the First Amendment of the U.S. Constitution (\u201c<i>Congress shall make no law respecting an establishment of religion\u2026<\/i>\u201d).\u00a0 Section 107(1), which allows clergy to reside tax-free in a church-provided parsonage, was not affected by the court\u2019s decision.<\/p>\n<p>In the case, Freedom From Religion Foundation, et al. v. Lew, et al., the United States government was the party which defended the constitutionality of Section 107, a federal law enacted by Congress many decades ago.\u00a0 As the losing party, the government must now decide whether it wants to appeal this decision to the next level of the federal court system, the Seventh Circuit Court of Appeals in Chicago.\u00a0 GCFA believes an appeal is likely.<\/p>\n<p>The court in Wisconsin delayed the implementation of its decision until any appeals which may be filed by the government are concluded or until the deadline for filing an appeal has passed, whichever is later.\u00a0 GCFA understands that the government will have 60 days to file an appeal, and so the district court\u2019s decision will have no effect until sometime in 2014 at the earliest.\u00a0 If an appeal is filed, it is certainly conceivable that this case could take several more years to be finally decided.<\/p>\n<p>GCFA is tasked by the Book of Discipline (the denomination\u2019s law book)\u00a0with the responsibility to protect the legal rights and interests of the United Methodist denomination.
